Measures for the Supervision and Administration of Entry Aquatic Animals Inspection and Quarantine.

These Provisions are formulated in accordance with the Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine and its implementing regulations, the Law of the People’s Republic of China on the Examination of Imported and Exported Commodities and the Law of the People’s Republic of China on the Import and Export Commodity Inspection and the Measures for the Protection of Fishery Production Republic of China, the Regulations of the People ‘s Republic of China on Quality and Safety of Agricultural Products, and the Special Provisions of the State Council on Strengthening the Supervision and Management of the Safety of Food and Other Products, and other laws and regulations.

These Measures shall apply to the supervision and administration of inspection and quarantine of aquatic animals entering the territory.

AQSIQ shall be responsible for the inspection, quarantine and supervision and management of aquatic animals entering the country. AQSIQ is located in the entry – exit inspection and quarantine departments are responsible for the entry of aquatic animals under the jurisdiction of the inspection and quarantine and supervision and management.

AQSIQ and the departments of inspection and quarantine shall carry out inspection and quarantine risk management on the basis of the risk analysis of the entry aquatic animals, and carry out classified management and credit management on the enterprises concerned.

Entering aquatic animal enterprises shall engage in production and business activities in accordance with laws, regulations and relevant standards, be responsible to society and the public, ensure the quality and safety of aquatic animals entering the territory, accept social supervision and undertake social responsibilities.

Health and safety assessment

AQSIQ implements quarantine access system for aquatic animals, including product risk analysis, assessment and review of safety and health control system, inspection and quarantine requirements, registration of offshore aquaculture and packaging enterprises.

Classification of Aquatic Animals for Inspection and Quarantine. According to the inspection and quarantine requirements, the first export of aquatic animals to the country or region of the product risk analysis and safety and health control system assessment of aquatic animals have been or are exported to China national or regional aquatic animal safety and health control system for retrospective review. AQSIQ formulate, adjust and publish the list of allowed entry aquatic animal species and exporting countries or regions.

AQSIQ shall sign the relevant protocol or determine the inspection and quarantine certificate in consultation with the competent authorities of the country or region where aquatic animals are exported to China, according to the risk analysis, assessment results and inspection and quarantine requirements.

AQSIQ administers the register of aquatic animal breeding and packaging enterprises in China.

Recommended file should include:

The overseas aquaculture and packaging enterprises (hereinafter referred to as the “registration enterprises”) exporting aquatic animals to China shall, in accordance with the relevant laws and regulations of the exporting country or region, submit the recommendation to the AQSIQ after obtaining the approval of the competent authority of the exporting country or region. Recommended files should include:

1. Enterprise information: name, address, the official department in charge of the approval number, breeding, packaging capacity.
2. aquatic animal information: breed aquatic animal species and packaging, scientific name, use.
3. monitoring information: the last time the enterprise, the official monitoring of toxic and hazardous substances results.

AQSIQ should review the recommended files

AQSIQ should review the recommended materials. If the examination is unqualified, it shall be supplemented by the official department of the country or region that has notified the exporting country. Examination of qualified, AQSIQ can send experts to apply for registration of enterprises to conduct random checks. AQSIQ regularly published, adjust the list of registered enterprises.

The registration period of overseas breeding and packing enterprises is valid for 3 years.

An enterprise that needs to renew its registration shall apply to the AQSIQ for an extension of at least 6 months before the expiry date of the expiry date by the competent exporting country or the local competent authority. AQSIQ can send experts to the exporting countries or regions to conduct a retrospective review of their safety and health control system and conduct random checks on overseas breeding and packaging enterprises that apply for extension. If an application for registration renewal is not filed within the time limit, AQSIQ will cancel its registration.

AQSIQ may revoke its registration if the registered aquaculture enterprise fails to pass the inspection and quarantine of the aquatic animals exported to China, if the circumstances are serious.

Overseas inspection and quarantine

Registered enterprises and relevant fishing areas shall comply with the relevant laws and regulations of the exporting country and be under the effective supervision of the competent authorities of the exporting country or region.

Aquaculture and ornamental aquatic animals shall be continuously monitored by the competent authorities of the exporting countries or regions for more than two years in accordance with the provisions of the exporting countries or regions and the provisions of the bilateral inspection and quarantine agreements in accordance with the methods and standards recommended by the World Organization for Animal Health.

The registered enterprises of edible aquatic animals shall be monitored by the relevant competent authorities of the exporting country or region in respect of aquatic animal diseases, toxic and harmful substances and pathogenic microorganisms and the results shall conform to the requirements of the bilateral inspection and quarantine agreements, the Chinese compulsory standards or the AQSIQ designated standards.

When a major aquatic animal epidemic occurs in a country or region where aquatic animals are exported to China, or a registered enterprise that exports aquatic animals to China is responsible for an unexplained large-scale death of aquatic animals in the fishing area, the competent authorities of the exporting country or region shall take the initiative Stop exporting to China and inform AQSIQ of the relevant information.

Aquatic animal semen and fertilized eggs exported to China must come from healthy parental populations. Before quarantine, aquaculture and ornamental aquatic animals are exported, they shall be subject to quarantine inspection at the place approved by the competent authority of the exporting country or region. AQSIQ may send quarantine officials to export countries or regions to assist in pre-export quarantine.

In accordance with the format and content of the inspection and quarantine certificates recognized by AQSIQ.

The registration of aquatic animals to be exported to China and the quarantine places shall have proper biosafety protection facilities and epidemic prevention management systems, which can effectively prevent the intrusion of aquatic animals in other waters and ensure the safety and hygiene of exported aquatic animals.

Aquaculture in different farms or fishing areas should be packaged separately, and different types of aquatic animals should be individually packaged to meet the animal’s survival and welfare needs. Packaging containers should be brand new or disinfected, to prevent leakage, the packaging should be transparent, easy to check.

The packaging water or ice and bedding materials for export to aquatic animals in China shall meet the safety and hygiene requirements, and shall not contain pathogenic microorganisms, harmful and harmful substances, and aquatic organisms that may damage the ecological environment of the aquatic animals and human health.

Aquatic animals exported to China shall have no clinical symptoms of zoonoses and parasitic diseases within 48 hours before transport. When necessary, the effective drugs approved by the competent authorities of the exporting country or region should be used for disinfection and de-worming.

The competent authority of the exporting country or region shall issue an inspection and quarantine certificate to aquatic animals exported to China in accordance with the format and content of the inspection and quarantine certificates recognized by AQSIQ.

Import inspection and quarantine.

China laws and regulations and mandatory standards:

1. AQSIQ classification of the development of inspection and quarantine requirements;
2. The relevant requirements of the bilateral inspection and quarantine agreement;
3. The relevant requirements stipulated in the inspection and quarantine certificates recognized by both parties;

The inspection and quarantine departments at the port of entry shall conduct on-site inspection of imported aquatic animals in accordance with the following provisions:

The inspection and quarantine department shall, in accordance with the relevant provisions, carry out epidemic prevention and disinfection treatment on the outer packing, means of transport and loading and unloading site of imported aquatic animals.

2. If the site needs to be unpacked for water or water exchange, the water used must meet the fishery water quality standard stipulated by China and be disinfected. Dispose of the original packaging, packaging water or ice and bedding materials in accordance with the relevant regulations.
3. Destroy the prohibited imports found.

5. The owners of the aquatic animals who have died shall be supervised by the consignor or their agents for innocent treatment.

Inspection and Quarantine Notice.

The inspection and quarantine department shall issue the Notice of Inspection and Quarantine Processing and the returned goods shall be returned or destroyed by the consignee or his agent under the supervision of the inspection and quarantine department if any of the following circumstances is found:

1. not included in the import of aquatic animal species and export the list of countries or regions.
2. No valid quarantine license.
3. No valid inspection and quarantine certificate issued by the competent authorities of the exporting country or region.
4. The applicant on the quarantine license, the consignee on the inspection and quarantine certificate and the consignee on the bill of lading are inconsistent; the actual transportation route is inconsistent with the quarantine license.
5. From unregistered enterprises.
6. The quantity of the imported aquatic animals exceeds the number of the inspection and quarantine certificates, the quantity of the imported aquatic animals is not more than the number of the inspection and quarantine certificates, the use of the false labels or the labeling is not complete or with the inspection and quarantine.

Aquatic animals transported to the inspection and quarantine departments designated temporary sites, laboratory testing before passing. If the laboratory test is unqualified, it shall be returned or destroyed.

Import species, aquaculture and ornamental aquatic animals should be in the designated isolation field for at least 14 days of isolation quarantine. After passing the inspection, the inspection and quarantine department at the port of entry shall issue the “inbound goods

Transit and transit inspection and quarantine.

If the aquatic animal is in transit, the carrier or the escort shall go through the formalities of quarantine examination and approval in accordance with relevant provisions, and issue a certificate issued by the competent department of the exporting country or region to the inspection and quarantine department of the import port.

Inspection by the inspection and quarantine department at the port of importation, the carrier or the escort shall be rectified in accordance with the requirements of the inspection and quarantine department if the packing container is found to be scattered during transportation. Transit through Hong Kong or Macao to the Mainland, the consignor or his agent should be designated to the AQSIQ inspection agency to apply for transit inspection. Without transit inspection or transit inspection failed, shall not be transported to the Mainland.

Transshipment by third-party countries or regions shall be issued by the third-party countries or regions in accordance with AQSIQ relevant requirements of the official documents issued by the interim, no valid proof of transit documents shall not be imported.

The inspection and quarantine departments shall carry out credit management on the consignees of imported aquatic animals in accordance with the Measures for the Administration of Credit of Entry – Exit Inspection and Quarantine Enterprises.

The inspection and quarantine departments shall conduct regular audits on the operating archives of the consignees of imported edible aquatic animals and, if they fail to do so, order rectification.

The consignees of aquatic animals for import, breeding and ornamental purposes shall, in accordance with the Measures for the Supervision and Administration of the Use of Imported Animal Isolation and Quarantine Fields, conduct the breeding and epidemic prevention work during the period of isolation of imported aquatic animals and keep relevant records. If the aquatic animals are imported with safety and health problems, the consignee shall take the initiative to take such control measures as recall and destruction, report immediately to the inspection and quarantine department, and report to the local government department. In any of the following circumstances, the inspection and quarantine department shall impose a fine of not less than 3,000 yuan but not more than 30,000 yuan in accordance with the Regulations on the Implementation of the Law of the People’s Republic of China on the Entry and Exit Animal and Plant Quarantine.

Unauthorized import and export of aquatic animals from the means of transport or delivery without the permission of the inspection and quarantine authorities.

Fines and penalties.

Under any of the following circumstances, criminal responsibility shall be investigated according to law; if the case does not constitute a crime or if the circumstances of the crime are not significant, the penalty shall not be imposed according to law. In accordance with the Regulations A fine of not less than 20,000 yuan but not more than 50,000 yuan shall be imposed:

1. Causing serious animal epidemic.

In case of any of the following circumstances, the inspection and quarantine department shall be fined not more than 30,000 yuan:

4. the establishment of operating files or not in accordance with the provisions of the record, the preservation of operating archives.
5. unauthorized removal or handling of imported edible aquatic animals detained in the designated places of the inspection and quarantine departments.
6. Refusing to accept the supervision and administration of the inspection and quarantine departments.

Where the consignees of imported aquatic animals or their agents, inspection and quarantine departments and their staff members have other illegal acts, they shall be dealt with in accordance with the relevant laws and regulations.

Inspection, quarantine and supervision and management of reptiles such as imported turtles, turtle, snakes and crocodiles shall be conducted with reference to these Measures.

Border Trade Inspection and quarantine of imported aquatic animals and supervision and management shall be carried out with reference to these Measures.

AQSIQ shall be responsible for the interpretation of these Measures.

The present Measures shall enter into force as of November 1, 2016. (Old Article 44) shall be repealed simultaneously.
